The “Always a Bridesmaid, Now a Bride” Contest NO PURCHASE IS NECESSARY TO ENTER OR WIN DESCRIPTION: The “Always a Bridesmaid, Now a Bride” Contest (the “Contest” ) is sponsored by Twentieth Century Fox Home Entertainment LLC (“Fox Home Entertainment”), 2121 Avenue of the Stars, Los Angeles, CA 90067 (Fox Home Entertainment is sometimes referred to herein as the “Sponsor”). Entries shall be accepted in person at the Boathouse in Central Park, East 72nd and Park Drive North, New York, NY on April 28, 2008, as described below. The Contest provides you with an opportunity to wear your worst bridesmaid dress for entry and consideration for a Prize (defined below) (the “Entry”). Each Entry shall be represented by one person (the “Entrant”). The Entrant shall be the contact person for all matters relating to the Contest. Furthermore, any Prize won shall be awarded in the name of the Entrant. By participating in the Contest, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules, the entry form found on the Contest page located at www.27dressesdvd.com/event (“Website”), the Terms and Conditions of Use of the Website and the decisions of the Sponsor, which shall be final and binding in all respects. To the extent the Terms and Conditions of Use of the Website and of these Official Rules conflict, the terms and conditions of these Official Rules shall prevail. ELIGIBILITY: No purchase is necessary to enter or win a Prize in the Contest. Only legal residents of the continental United States and Washington D.C. who are eighteen (18) years of age or older as of 12:00:01 a.m. ET on April 28, 2008, are eligible to enter the Contest. The Contest is void in states and/or jurisdictions where prohibited or otherwise restricted by law. Employees of the Sponsor, Best Buy Stores, L.P., and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers and directors, or any persons or entities directly associated with the Contest and members of their immediate families and/or persons living in the same household as such persons (collectively, the “Promotion Entities”), are ineligible to enter the Contest or win a Prize. HOW TO ENTER: Beginning 7:00 am Eastern Time (“ET”) on April 28, 2008 through 8:30 am ET on April 28, 2008 (the “Entry Period”), enter by: 1) wearing or bringing your worst bridesmaid dress; 2) arriving in person to The Boathouse in Central Park, New York; and 3) being one of the first 400 people to gain entry. You must be wearing your bridesmaid dress and present at The Boathouse to be considered. Limit one (1) entry per person as determined by name for a maximum of one entry for the entire Entry Period. Multiple entries received from any person after the first entry received will be void. For any participant’s Entry to become valid and in order for his or her dress to be considered, participant must acknowledge reading, accepting, and agreeing to the terms and conditions set forth in these Official Rules. JUDGING: At the end of the Entry Period, and assuming a sufficient number of entrants are present, twenty-seven (27) entrants will be selected by representatives from Fox Home Entertainment at 9:00 am ET based on the judging criteria below, to be presented in front of a panel of judges as chosen by Fox Home Entertainment. Judging of the 27 finalists shall begin at The Boathouse at 10:00 am ET. Judging shall be based on the following equally weighted judging criteria: originality and embellishment. The Judges, in their sole discretion, will select one (1) Grand Prize Winner and twenty-six (26) Runner-Up Winners from the 27 finalists. Judges decisions are final and binding with respect to all matters related to the Contest and entrants must agree to be bound by these decisions. By entering the Contest, entrants agree to waive any right to claim any ambiguity or error in these Official Rules or the Contest itself. All winners will be notified on site. One (1) Grand Prize Winner will receive one (1) gift certificate redeemable solely for a special order bridal gown with a retail price up to $10,000 at Kleinfeld Manhattan located at 110 West 20th Street, New York, NY 10011 ("Kleinfeld Gift Certificate"), one (1) Cargo Makeup Gift Basket, and one (1) Best Buy gift package. The Approximate Retail Value (“ARV”) of Grand Prize is $14,300. The Best Buy gift package consists of one (1) Blackberry Phone (exact model will depend on Grand Prize Winner’s wireless carrier), a Fashion Accessories Collection, and a Home Theatre System. The Fashion Accessories Collection consists of one (1) Laptop Bag Croc Tote, one (1) Laptop Sleeve, one (1) Cell Phone Foldover Case, and one (1) MP3 Player Sleeve (exact model will depend on Grand Prize Winner’s MP3 Player). There is no substitution, transfer, refund or cash equivalent for the Prize (or any Grand Prize component), except that Sponsor may substitute a prize (or Prize component) with one of equal value or greater for any reason at their sole discretion. If Grand Prize Winner is not able or willing, for any reason, to receive the Prize in accordance with the terms and conditions set forth in these Official Rules, the Prize will be forfeited and an alternate winner will be selected. Grand Prize Winner is solely responsible for all federal, state, and local taxes on Prize and Sponsor shall have the right, but not the obligation, to make any deductions and withholdings that Sponsor deem necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances. Sponsor makes no representations or warranties of any kind concerning the appearance, safety, quality or performance of any portion of Prize. Grand Prize Winner bears all risk of loss or damage to any portion of Prize after delivery and accepts all risks associated with the delivery and use of the Prize. If a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsor' Prize obligation to the Grand Prize Winner, and no additional compensation will be awarded. All prize details, including without limitation, all gift basket contents and accessories are at the sole discretion of the Sponsor. Total ARV value of all prizes: $19,500. All 27 Finalists will be required to complete an Affidavit of Eligibility and Liability/Publicity Release and other tax documents required by Sponsor prior to being presented in front of the panel of judges. Any Finalist who declines to complete paperwork will be disqualified from the Contest and an alternate Finalist will be selected. GENERAL LIABILITY RELEASE/FORCE MAJEURE: Entrants agree that the Promotion Entities (A) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from the Contest or any Contest-related activity, or from Entrants’ acceptance, receipt, possession and/or use or misuse of the Prize(s), and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Prize(s), including, without limitation, to such Prize’s quality or fitness for a particular purpose. Entrant agrees that Sponsor, Best Buy Stores, L.P., and their respective parents, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent, subsidiaries, affiliated and successor companies and each such company’s officers, directors, employees, attorneys and agents and any other person or entity associated with such entities and/or this Contest (collectively, the “Released Parties”) are released by you and shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of Prizes. Entrant (or, if a minor, your parent(s) or legal guardian(s)) further agrees that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, you will indemnify the Released Parties from any and all such claims, including the attorney’s fees related thereto. Sponsor assumes no responsibility for any damage to an Entrant’s property, including any bridesmaid dress which is occasioned by participating in the Contest. Sponsor assumes no responsibility for any damage to an Entrant’s computer system which is occasioned by accessing the Website or participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged or stolen entries or Prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in their sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding Prize(s) or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date and time, Sponsor will (if possible) select the Winners from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. |
